Lookout Cruises – Terms & Conditions

Thank you for choosing Lookout Cruises. Please read the following Terms & Conditions carefully before booking your cruise. By making a reservation, you agree to the terms set forth below, which are designed to ensure a safe and enjoyable experience for all guests.

1. Participation Requirements

  • All adult guests must present a valid, government-issued photo ID at check-in. This is mandatory for age verification, especially for the consumption of alcoholic beverages.

  • Guests must be at least 18 years of age to book online. Minors under 18 must be accompanied by a parent or legal guardian throughout the duration of the cruise.

  • Each guest must sign a waiver before participating in any tour or activity. You may be asked to complete this electronically or in person prior to boarding.

  • Guests are responsible for informing us of any medical conditions, disabilities, or special requirements at the time of booking so we can make reasonable accommodations where possible.

2. Departure Location & Arrival Time

  • All cruises depart from Beaufort, North Carolina. Please refer to your confirmation email for the exact meeting location and arrival instructions.

  • We recommend arriving at least 30 minutes prior to your scheduled departure time. Late arrivals may be considered a no-show and are non-refundable.

  • Parking, traffic, and other delays are the responsibility of the guest. We cannot delay departures for late arrivals.

3. Minimum Passenger Requirement

  • A minimum of 12 confirmed guests is required for most public cruises to operate.

  • If this minimum is not met, we reserve the right to cancel or reschedule the cruise. Guests will be notified via phone or email and given the option to reschedule or receive a full refund.

4. Weather Policy & Captain's Discretion

  • For your safety, all tours are subject to cancellation or modification due to inclement weather, hazardous conditions, or the captain's discretion.

  • If your tour is canceled by us, you will have the choice of:

  • Rescheduling your trip (subject to availability), or

  • Receiving a full refund for the amount paid.

  • We monitor weather conditions closely and will notify guests as soon as possible if a tour must be canceled.

5. Cancellation & Refund Policy

Weather & Captain Discretion

If your tour is cancelled due to weather conditions or at the Captain’s discretion, you will receive:

  • A full refund, or

  • The option to reschedule based on availability

Cancellation & Rescheduling Policy

Cancellation windows vary depending on group size:

Groups of 1–5 Guests

  • 48+ hours before departure: Full refund or reschedule

  • Less than 48 hours: No refund (100% charge applies)

Groups of 6–10 Guests

  • 7+ days before departure: Full refund or reschedule

  • Less than 7 days: No refund (100% charge applies)

Groups of 11–15 Guests

  • 14+ days before departure: Full refund or reschedule

  • Less than 14 days: No refund (100% charge applies)

Groups of 16–20 Guests

  • 21+ days before departure: Full refund or reschedule

  • Less than 21 days: No refund (100% charge applies)

Groups of 21+ Guests

  • 28+ days before departure: Full refund or reschedule

  • Less than 28 days: No refund (100% charge applies)

Important Notes

  • Late arrivals and no-shows will be charged 100% of the booking

  • All reschedules are subject to availability

  • By booking, guests agree to this cancellation policy

6. Rescheduling Policy

  • You may request to reschedule your booking 48 hours or more in advance of your cruise (7 days for group bookings of 10+).

  • Rescheduling is subject to availability and not guaranteed.

  • Requests made after these deadlines will not be honored and will be treated as cancellations without refund.

7. Payment Methods

  • All online reservations are processed through FareHarbor, our secure booking platform, which acts as a limited payment agent on our behalf.

  • We accept major credit cards through FareHarbor for online bookings.

  • You may also make a reservation in person at our ticket booth, where we accept credit cards and cash payments.

  • Full payment is required at the time of booking to confirm your reservation.

8. Booking Modifications

  • Modifications to your reservation (date, time, number of guests) must be requested at least 48 hours prior to departure. 

  • We will do our best to accommodate changes, but modifications are not guaranteed and are subject to availability.

  • Cancellation & Rescheduling Policy

  • Groups of 1–5 Guests

Less than 48 hours: No refund (100% charge applies)

  • Groups of 6–10 Guests

7+ days before departure: Full refund or reschedule

  • Groups of 11–15 Guests

14+ days before departure: Full refund or reschedule

Less than 14 days: No refund (100% charge applies)

  • Groups of 16–20 Guests

21+ days before departure: Full refund or reschedule

Less than 21 days: No refund (100% charge applies)

  • Groups of 21+ Guests

28+ days before departure: Full refund or reschedule

Less than 28 days: No refund (100% charge applies)

9. Liability Waiver & Assumption of Risk

Assumption of Risk

  • I understand that the activities in which I voluntarily choose to participate (the “Activities”) provided by Pura Vida Ventures, Inc., doing business as Lookout Cruises (“Lookout Cruises”) involve inherent risks and dangers, including but not limited to:

  • Slips, trips, and falls on wet or uneven surfaces

  • Boarding and disembarking vessels

  • Rough water, waves, and changing sea conditions

  • Seasickness or physical discomfort

  • Weather-related hazards

  • Drowning or water-related injuries

  • Equipment malfunction or failure

  • Actions of other passengers

  • I acknowledge that these risks may result in property damage, personal injury, illness, or death. I knowingly and voluntarily assume all such risks and accept full responsibility for any loss, damage, injury, illness, or death that may occur as a result of my participation in the Activities.

Waiver and Release

  • In consideration of Lookout Cruises providing services and facilities, and on behalf of myself and my family members, heirs, representatives, and assigns:

  • I agree to comply with all rules, policies, and instructions provided by Lookout Cruises, including directions from the captain and crew. I understand that failure to follow such instructions may result in removal from the Activity without refund.

  • I knowingly and voluntarily waive, release, and discharge Pura Vida Ventures, Inc., d/b/a Lookout Cruises (“Lookout Cruises”) from any and all claims, liabilities, damages, or causes of action, including those arising from the negligence (including ordinary negligence) of Lookout Cruises, related to any property damage, loss, personal injury, illness, emotional distress, or death arising from my participation in the Activities.

  • This waiver and release is intended to be as broad and inclusive as permitted by law.

Indemnification

  • For purposes of this Agreement, “Indemnified Parties” includes Pura Vida Ventures, Inc., doing business as Lookout Cruises (“Lookout Cruises”), and its owners, officers, employees, captains, crew members, agents, contractors, and affiliates.

  • I agree to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all claims, demands, actions, damages, losses, liabilities, or expenses (including attorney’s fees) arising out of or related to my participation in the Activities or my use of Lookout Cruises’ vessels, property, facilities, or services.

Medical Authorization

  • I authorize Lookout Cruises and its representatives to obtain emergency medical care on my behalf in the event of injury, illness, or other emergency. I accept full responsibility for any costs associated with such medical care.

Personal Property

  • I understand and agree that Lookout Cruises is not responsible for the loss, theft, or damage of any personal belongings.

Photography and Media Release

  • I grant permission to Lookout Cruises to take and use photographs, video, or other images of me during the Activities for any lawful purpose. I waive any rights to compensation, privacy, publicity, or ownership related to such media.

Behavior and Safety

  • I acknowledge that unsafe behavior, including but not limited to intoxication or failure to follow instructions, may result in my removal from the Activity without refund.

Physical Condition and Ability

  • I certify that I am physically and mentally capable of participating in the Activities and possess the necessary skills and ability to do so safely.

Scope of Agreement

  • This Agreement applies to all aspects of participation in the Activities, including but not limited to boarding, disembarking, time spent on docks, and time before, during, and after the tour.

Governing Law and Venue

  • This Agreement shall be governed by the laws of the State of North Carolina. Any legal action arising from this Agreement shall be brought exclusively in Carteret County, North Carolina.

Severability

  • If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Minor Participant (Under 18 Years of Age)

  • I certify that I am the parent or legal guardian of the minor participant. I consent to the minor’s participation in the Activities and agree to all terms of this Agreement on their behalf.

  • I further agree to indemnify and hold harmless Lookout Cruises from any claims brought by or on behalf of the minor.

  • I authorize emergency medical treatment for the minor and accept full responsibility for all related costs.

10. Privacy Policy

  • We value your privacy. All data collected during booking is handled in accordance with FareHarbor’s Privacy Policy. Lookout Cruises does not sell or distribute your personal information to third parties.

11. General Conduct & Safety

  • Guests must follow all instructions given by the captain and crew at all times.

  • Disruptive, unsafe, or intoxicated behavior may result in denial of boarding or removal from the vessel without refund.

  • We reserve the right to refuse service to any individual who poses a risk to the safety or enjoyment of others.

12. Photo & Video Release 

  • By completing your booking with Lookout Cruises, you acknowledge and agree that you and all members of your party may be photographed and/or recorded during the experience.

  • You grant Lookout Cruises the irrevocable and unrestricted right to use, reproduce, and publish these images and videos for marketing, advertising, and promotional purposes, including but not limited to social media, website content, digital campaigns, and printed materials, without compensation.

  • You waive any right to inspect or approve the final content and release Lookout Cruises from any claims, demands, or liability related to the use of such media.

  • If you prefer not to appear in photos or videos, you must notify our crew prior to departure, and we will make reasonable efforts to accommodate your request.

13. Changes to Terms

  • Lookout Cruises reserves the right to update or modify these Terms & Conditions at any time. Changes will be posted on our website and are effective immediately upon publication.
